How the contract is formed between you and us

By placing an order with us via this website you are making an offer to us to purchase the products detailed in your order upon the terms described in your order. Once you have placed your order we will send you a confirmation email that your order has been received but this is not a confirmation that your order has been accepted. A contract between you and us for the sale of our products will only exist once an order has been accepted, processed and despatched to you.

Payment

Payment is by credit or debit card via Paypal, you may also use your paypal account to make payment.

Prices

The price of any products will be as quoted on our website from time to time, except in cases of obvious error. These prices include VAT, if any, but exclude delivery costs, which will be added to the total amount due. We reserve the right to amend prices without notice, but changes will not affect orders already confirmed.

Product descriptions

We have done our best to ensure that all product descriptions, measurements and photographs are as accurate as possible. As many of our products are handmade there may be slight variations in colour, finish and size.

Stock availability

Occasionally products will be out of stock. Should you order a product that is out of stock we will contact you by email to advise you that the item is unavailable, give you an estimated date for the product coming back into stock and allow you to decide how you wish to proceed.

Delivery, postage and packaging

We aim to deliver within 3 to 5 working days of receipt of your order where possible. We deliver within the UK and to the Republic of Ireland. If you wish to have goods delivered outwith the UK & ROI please contact us. Should you require faster and guaranteed delivery please get in touch, special delivery will be charged at cost.

The products will be at your risk from the time of delivery. Ownership of the products will only pass to you once we have received full payment of all sums due in respect of the products, including delivery charges.

Wherever possible we reuse and recycle packaging and urge you to do the same.

Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control, including (without limitation), strikes or other industrial action, fire, storm, flood or other natural disaster. Our performance under any contract is deemed to be suspended for the period that such event continues, and we will have an extension of time for performance for the duration of that period.

Cancellation

Should you wish to cancel your order you should contact us by email as soon as possible. If the order has already been dispatched you should proceed under the Returns Policy.

Orders may be cancelled within 7 working days from the day after receipt of goods. In this case, you will receive a full refund of the price paid for the products.

Returns

Goods should be returned within 7 days of receipt in original packaging and in a saleable condition. All returns must be authorised by us before you attempt to return the itmes. Please note that when returning an item(s), the parcel is your responsibility until it reaches us. We advise that you obtain proof of posting.

For hygiene reasons earrings cannot be returned unless damaged or faulty. This does not affect your statutory rights.

Please note that the cost of returning items, except in the case of damaged or faulty items or where we have made an error, shall be borne by you.

Damaged goods

Please notify us of any damaged goods within 7 days of receiving the order. We will instruct you with regard to returning the item(s) and agree with you a replacement(s) or refund.

Liability

We do not seek to exclude or limit liability for death or personal injury arising from our negligence or for any fraudulent misrepresentation.

To the fullest extent permitted by law and save as provided above, we shall not be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence, for any indirect, special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of products or their use by you.

The entire liability of us under or in connection with any contract for any products to which these terms and conditions apply shall not exceed the price of the products, except as expressly provided in these conditions.

Law and jurisdiction

Contracts for the purchase of products through our website will be governed by Scots law. Any dispute arising from, or related to, such contract shall be subject to the non-exclusive jurisdiction of the courts of Scotland.

Privacy

Your details collected from the ordering process will be stored by Green Gift Company Ltd. in accordance with the Data Protection Act 1998. We do not pass customer details to third parties.

Please note we do not keep payment details on our system.
